Commencement of certain sections of the Criminal Justice (Miscellaneous Provisions) Act 2023

The following sections of the Criminal Justice (Miscellaneous Provisions) Act 2023 have been commenced since the 1st August 2023

1. (1) This Act may be cited as the Criminal Justice (Miscellaneous Provisions) Act 2023. (2) Part 3 and the Firearms Acts 1925 to 2009 may be cited as the Firearms Acts 1925 to 2023 and shall be construed together as one.

1 (5) This Act shall come into operation on such day or days as may be appointed by order or orders made by the Minister for Justice, either generally or by reference to any particular purpose or provisions, and different days may be so appointed for different purposes or different provisions.

2. The expenses incurred by the Minister for Justice in the administration of this Act shall, to such extent as may be sanctioned by the Minister for Public Expenditure, National Development Plan Delivery and Reform, be paid out of monies provided by the Oireachtas.

s.61 Amendment of section 2 of Criminal Justice Act 1993 - Review of certain sentences - undue leniency appeal by DPP

s.62 Amendment of section 3 of Criminal Procedure Act 1993 - Jurisdiction of Court or Criminal Appeal in relation to appeals

s.71 Amendment of Garda Síochána Act 2005 71. Section 122(5)(b)(ii) of the Garda Síochána Act 2005 is amended by the substitution of “section 51(2)(d)” for “section 51(2)(b)”.

s.74 Amendment of Schedule 2 to Criminal Justice Act 2007 75. Schedule 2 to the Criminal Justice Act 2007 is amended in paragraph 2 by the insertion of the following subparagraph after subparagraph (a): “(aa) section 4A (non-fatal strangulation or non-fatal suffocation causing serious harm);”
